ACC Applications/Home Modification Rules
Confused about how to submit a design modification application? We're here to help! Before getting started, review the Design Guidelines to understand any modification limitations and ensure your project is in compliance.
Be sure to submit well before you want to start your project! Applications need to be approved before the work begins for all changes to your home or landscaping. The ACC committee has a maximum of 45 days to review your application to make sure it aligns with design guidelines before approving or denying it. The ACC committee are the ONLY ONES who can approve or deny applications.
If you have questions at any point while working to complete the application, email StoneGateACC@ccmcnet.com or call (832) 653-3763 for assistance. If the application is incomplete, there are questions, or more information is required (photos, etc.), a team member will contact you.
Decisions are then communicated to homeowners via email within 45 days. If approved, you can move forward with the project.

Holiday Exterior Light Rules & Policy
- Thanksgiving exterior decorations may be installed November 10 and must be removed by December 1
- Holiday decorations may be installed the day after Thanksgiving and must be removed by January 5
- Decorations must not be excessive or cause a nuisance
- The Association has sole discretion to determine if decorations constitute a nuisance
Lot/Yard Party Rules
If you are planning a party at your residence please notify the HOA office 48hrs before your event to ensure you recieve no parking violations, fines, or towing at your property.

Noise Complaints: HOA vs Police clarification
HOA vs Police clarification
HOA Responsibility (Long-term / Rule Violations)
Authority: HOAs can enforce noise restrictions outlined in their Governing Documents (CC&Rs).
Action: They can issue warnings, hold hearings, impose fines, or, in rare cases, seek court injunctions.
Best for: Ongoing, persistent issues like a barking dog, loud music during the day, or recurring construction noise that breaks community rules.
Limitations: HOAs are not 24/7, cannot act immediately, and cannot "arrest" or physically stop a neighbor.
Constable/Police Responsibility (Immediate / Legal Violations)
Authority: Police enforce municipal or county noise ordinances and state criminal laws.
Action: They can come to the scene, take complaints, issue citations, or stop the noise immediately.
Best for: Loud, disruptive parties, shouting, or excessive noise after hours (10 PM – 6 AM).
Limitations: Police do not enforce HOA-specific rules, such as a lower decibel limit written in the bylaws.

When to Call Whom
Call the Police When: The noise is occurring in real-time, violates local "quiet hours," or is excessively loud at night.
Contact the HOA When: The noise is a regular, recurring, or persistent issue, even if it is not legally "loud" by city standards, but violates the community's quiet enjoyment policy.
Document Everything: In both cases, keep a log of dates, times, descriptions, and, if possible, recordings of the noise.

Parking Rules
The capitalized terms used in these Parking Rules will have the same
definitions as set forth in the Declarations, unless otherwise defined below. Some of
the terms defined below, but are included here for ease in review and interpretation of
these Parking Rules.

1.1 Association - shall mean and refer to S-G Owners Association, Inc., a Texas nonprofit corporation, its successors and assigns.
1.1 Board of Directors - shall mean the duly appointed or elected board of directors
of the Association.
1.2 Daylight Hours - shall mean all hours of the day except for Overnight Hours, as
defined herein.
1.3 Declarations - shall collectively mean all of the Declarations for all of the
subdivisions under the jurisdiction of the Association, listed in the attached
Exhibit "A".
1.4 Driveways - as used in these Parking Rules shall mean all Driveways on all Lots.
1.5 Gated Section - shall mean those Sections of the Property that are located behind
limited access entrance gates.
1.6 Non-Gated Section - shall mean those Sections of the Property that are not
located behind limited access entrance gates.
1.7 Operating Condition - shall mean the condition of a vehicle that (i) has no flat
tires; (ii) is not wrecked; (iii) is not inoperable; (iv) is not abandoned; (v) is not
on jacks or blocks; (vi) is not leaking any oil or other fluids; (vii) has current
license plates and inspection stickers; and (vii) is otherwise capable of being
legally operated on the roads and highways of the State of Texas.
1.8 Overnight Hours - shall mean 10:00 p.m. to 7:00 a.m. Sunday - Thursday and
midnight - 7 am on Fridays, Saturdays, and Federal holidays.
1.9 Owner - shall mean and refer to the record owner, whether one or more persons
or entities, of a fee simple title to any Lot or parcel of land which is a part of the
Property, including executory contract sellers, but excluding those having such
interest merely as security for the performance of an obligation.

1.10 Parking Rules - shall mean these "Amended and Restated Parking Rules for S-G
Owners Association, Inc."
1.11 Permitted Vehicle(s) - shall mean: vehicles that (i) do not exceed either six feet
six inches (6'6") or eight feet (8') in height as required by the Declaration for the
Section in question where the Resident resides, (ii) do not exceed seven feet six
inches (7'6") in width, (iii) do not exceed twenty-one feet (21') in length; (iv) are
not golf carts, ATVs, UTVs, go-karts, dirt bikes, tractors, or any similar type of
vehicle, (v) are not Commercial Vehicles, as that term is defined herein, and (vi)
are in an Operating Condition, as that term is defined herein.

of the Association.
1.14 Public Street(s) - shall mean the public streets in the Non-Gated Sections of the
Property.
1.15 Resident - shall mean and refer to (i) each Owner residing in his/her residence;
(ii) each person residing in a residence who is a bona fide tenant of the Owner of
such residence; and (iii) each person domiciled in a residence other than an Owner
or bona fide tenant.
1.16 Resident Permitted Vehicle - shall mean a Permitted Vehicle owned, operated,
or in the possession, custody or control of a Resident.
1.17 Section - shall mean a subdivision under the jurisdiction of the Association, listed
in the attached Exhibit "В"
1.18 Street(s) - shall mean both Public and Private Streets in the Property.

3.1 Only Permitted Vehicle(s) may be parked in the Property at any time. However,
a vehicle that is not in Operating Condition may be stored out of view of the
Street(s), other Lot(s), and the Common Area(s) in the garage of a Lot, and may
be taken out onto the Driveway of the Lot to the extent necessary to repair or otherwise bring the vehicle into Operating Condition, but only for so long as reasonably necessary and never during Overnight Hours.

3.2 Resident Permitted Vehicle(s) may only be parked in the Street during
DAYLIGHT HOURS when (and ONLY when) the driveway of their Lot is NOT
capable of being occupied by a Permitted Vehicle. Resident Permitted Vehicles
may not be parked in the Street during Daylight Hours in any other instance.
3.3 No Resident Permitted Vehicles may be parked in the Street during
OVERNIGHT HOURS
3.4 Guests of Residents are permitted to park their Permitted Vehicles in the Street
when (and ONLY when) the Driveway of the Resident they are visiting is not
capable of being occupied by their Permitted Vehicle. Otherwise, guests of
Residents must park their Permitted Vehicles in the Driveway of the Resident
they are visiting. This provision does not apply to periodic service providers that
are providing a service to a Resident's Lot (e.g. construction workers, landscapers,
plumbers, etc.), but does apply to caregivers or domestic help that provide
services to the Resident on a routine basis.
3.5 Depending on the construction of the Driveway, Permitted Vehicles parked on
Driveways must be parked so that either: (i) the front or rear of the Permitted
Vehicle faces the garage, or (ii) the front or rear of the Permitted Vehicle faces
the Street in front of the residence, as applicable. The intent of this section is to
prohibit unorthodox parking on Driveways (e.g. horizontal parking on a
Driveway in front of a garage).
3.6 AT THE RISK OF BEING SUBJECTED TO THE PROVISIONS OF
ARTICLE IV AND V, HEREIN, AND THE VEHICLE BEING TOWED
WITHOUT OTHER PRIOR WARNING AND THE OWNER/RESIDENT
FINED, regardless of whether a Permitted Vehicle is permitted to park in
the Street because one of the foregoing conditions has been met, and
regardless of whether or not the Driveway of a Lot is incapable of being
occupied by a Permitted Vehicle, no vehicle-including any Permitted
Vehicle-may under any circumstance:
- be parked in a fire zone, fire lane, tow away zone, or area otherwise designated as a, "No Parking," zone;
- be parked in a handicap spot without displaying proper identification;
- be double parked or parked "over the line,"in the parking lots on the Common Area(s);
- be parked on the Common Area, except for the designated parking spots thereon, and only during Daylight Hours and while utilizing the Common

Street because one of the foregoing conditions has been met, and regardless
of whether or not the Driveway of a Lot is incapable of being occupied by a
Permitted Vehicle, no vehicle-including any Permitted Vehicle-may
under any circumstance:
- except as provided in Paragraph 3.1, not be in Operating Condition while viewable from the Street(s), other Lot(s), or Common Area(s);
- be parked more than eighteen inches (18") from the curb;
- be parked within fifteen feet (15') of a fire hydrant;
- be parked within thirty feet (30') of a stop-sign;
- be parked in any area designated as "No Parking" either by a sign or painted curb signifying the same and/or painted red
- be parked perpendicular to the roadway in cul-de-sacs, or in the middle of a cul-de-sac, or doubled-parked in a cul-de-sac;be parked on the lawns in the Property or any portion of sidewalks in the Property that are not crossed by the driveway on that Owner's Lot;
- be parked in violation of any provisions of Paragraphs 3.1 through 3.5;
3.8 The provisions of foregoing Paragraphs do not apply to (i) Permitted Vehicles
that are official law enforcement vehicles (e.g. city, county or state), clearly
identified as such, or (ii) emergency vehicles providing services to a Lot,
including but not limited to fire or emergency medical services.

3.9 The Board of Directors may, from time to time, grant temporary variances to
some or all the provisions of this Article III as it deems appropriate and necessary

temporary variance to maintain a pass prominently displayed in or on the vehicle
so as to be easily identified.
3.10 A Commercial Vehicle (as defined below) may not be parked in any area of the
Property if visible from a Street, except a vehicle that is otherwise a Commercial
Vehicle but is operated by a contractor for a delivery or to perform service, repair,
or maintenance work on a Lot or on a Common Area, but then only during the
period necessary for the delivery or to perform the work. A Commercial Vehicle

The term "Commercial Vehicle" is defined to include, but is not limited to, all of
the following:

- Chassis cab conversions, cutaway van conversions, flatbed trucks, walk-in vans (for example, UPS trucks), vehicles with reconfigured cargo areas, trucks with beds removed; or
- Buses, passenger vans, and stretch limousines; or
- A vehicle with signage or logos or letters or advertisements or phone number(s) or email addresses or other contact information displayed on the exterior of the vehicle. This provision includes magnetic signs displayed on the exterior of vehicles; or
- A vehicle with irregular or distinct coloring which, in the sole and absolute
discretion of the Board of Directors, creates the appearance of a commercial
vehicle; or - Vehicles with externally mounted racks (including "headache racks" / "back
racks" which are generally designed to keep shifting cargo from penetrating cab
rear windows), frames, shelves, boxes, and other containers for the storage and
transportation of tools, mounted specialized equipment, tanks, and materials (a
single closable tool box mounted at the front of a pickup truck bed is an
exception); or - A vehicle with installed equipment commonly used for a commercial or
industrial function, such as, by way of example and not in limitation, tail lifts,
loaders, hoists, winches, vises, pumps, cherry-pickers; or - A vehicle with commercial paraphernalia or equipment strapped or otherwise
affixed to the exterior of the vehicle including, but not limited to, tools, ladders,
storage containers, and building materials; or - A vehicle with an excessive amount (as determined in the sole and absolute
discretion of the Board of Directors) of commercial supplies which are in plain
view including, but not limited to, building materials, paint buckets, tanks, cans,
bags, pesticides, fertilizer, cabling, uncovered or unsecured tools, waste
material, scrap, and debris; or - A vehicle which transports or stores restricted articles, hazardous or dangerous
products or goods; or - A vehicle which transports or stores liquids, gases, or solids that are capable of
harming people, property, or the environment; or - A vehicle which transports or stores liquids, gases, or solids which are
flammable, corrosive, explosive, or toxic.
Towing Rules
1. As used herein, “abandoned vehicle” shall mean and refer to any vehicle that:
- Displays an expired/invalid registration; and/or,
- Displays an expired/invalid license plate; and/or
- Does not display a license plate; and/or,
- Has one (1) or more flat tires; and/or,
- Is unable, due to any damage and/or missing component (including, but not limited to, missing mirrors or Windshields), to lawfully operate on public highways in the State of Texas.
Area where parking is prohibited and that is so marked or designated by markings and/or signage
compliant with the Texas Occupations Code.
3. As used herein, “private streets” shall mean and refer to any street, drive, or right of way,
owned by the Association, maintained by the Association, and used for ingress and egress into or
around the Subdivision or any part thereof.
4. As used herein, “Common Area” shall have the same meaning as in the Declarations.
5. Each Owner is and shall be responsible for ensuring that the Owner, Owner’s family, tenants,
occupants, guests, and/or invitees, comply with the restrictive covenants, rules, and regulations,
regarding parking, keeping, or storing, vehicles in the Subdivision. In the event an Owner, or
Owner’s family member, tenant, occupant, guest, or invitee, violates the restrictive covenants, rules,
and regulations, regarding parking, keeping, or storing, vehicles in the Subdivision, such violation
shall inure to Owner.
6. The Association shall contract with a well-qualified and fully insured tow company, to
facilitate the towing of vehicles parked in violation of the restrictive covenants, rules, and
regulations, regarding parking, keeping, or storing, vehicles in the Subdivision

7. The following procedures shall govern the towing of vehicles parked in Common Area and/or
the private streets in violation of the restrictive covenants, rules, and regulations, regarding parking,
keeping, or storing, vehicles in the Subdivision:
Towing of Vehicles for Violations of the Association’s Parking Requirements:
- In the event of any violation of the restrictive covenants, rules, and regulations, imposed by the Declarations regarding the parking, keeping, or storing of vehicles on Common Area or the private streets, the Association (by and through its agents, managers, officers, or directors, as authorized by the Board of Directors) shall:
1. note the make, model, color, and license plate of the vehicle, and shall photograph the vehicle in a fashion that clearly documents the violation; and;

sixty (60) days, then on the fifth violation, the Association (by and through its
agents, managers, officers, or directors, as authorized by the Board of
Directors) shall, pursuant to Section 2308.252 of the Texas Occupations Code,
provide those notices and certified letters that shall enable the towing of such
vehicle; more specifically, the Association shall:

agents, managers, officers, or directors, as authorized by the Board of
Directors) shall, pursuant to Section 2308.252 of the Texas Occupations Code,
provide those notices and certified letters that shall enable the towing of such
vehicle; more specifically, the Association shall:
1. Attach a conspicuous notice to the vehicle’s front windshield or, if the
vehicle has no front windshield, to a conspicuous part of the vehicle:
- Stating that the vehicle is in a parking area in which the vehicle is not authorized to be parked and a description of the violation that renders the vehicle not authorized to be parked;
- Giving a description of all other unauthorized areas in the Subdivision where such vehicle could not be parked;
- Stating the vehicle will be towed at the expense of the owner or operator of the vehicle if it remains parked in violation of the Association’s parking rules;
- Providing and a telephone number that is answered twenty four (24) hours a day to enable the owner or operator of the vehicle to locate the vehicle; and,
receipt requested, to the last address shown for the owner according to
the vehicle registration records of the Texas Department of Motor
Vehicles, or if the vehicle is registered in another state, the appropriate
agency of that state, and such notice must include all language in the
notice affixed to the vehicle, as well as a warning that the unauthorized
vehicle will be towed at the expense of the owner or operator of the
vehicle if it is not removed from the parking facility before the
fifteenth (15m) day after the postmark date of the notice; and,
Shall mail the Owner responsible for the violation, notice of the
violation, by certified mail, and such notice shall provide any and all
notice(s) required by Section 209.006 of the Texas Property Code, or
its successor statute, and the Association shall inform the Owner of,
and allow the Owner the Opportunity to exercise, all rights, remedies,
and opportunities, made available to the Owner under Section 209.006
of the Texas Property Code, or its successor statute, or other applicable
law.

owner of such vehicle shall be responsible for any and all fees, costs, charges,
and/or expenses, association with such tow and/or associated with the
recovery of the towed vehicle from the contracted towing company.

In the event the Association designates any Common Area or any portion of
the private streets as no-parking zones, the Association shall mark and identify
such no—parking zones with the appropriate lawful signage, pursuant to
Section 2308.252(a)(1) of the Texas Occupations Code, to enable immediate
towing of vehicles parked in no-parking zones.

In the event the Association’s contracted towing company identifies any
vehicle parked, kept, or stored, in a no-parking zone, the Assooiation’s
contracted towing company may, without additional notice beyond that

vehicle and the owner of such vehicle shall be responsible for any and all fees,
costs, charges, and/or expenses, association with such tow and/or associated
with the recovery of the towed vehicle from the contracted towing company.
Towing of Abandoned Vehicles:
In the event an abandoned vehicle is parked, kept, or stored, on the
Association’s Common Area or private streets, the Association shall generally
follow the same procedures as outlined for violation of the restrictive
covenants, rules, and regulations, imposed by the Declarations regarding the
parking, keeping, or storing of vehicles on Common Area or the private
streets, except that the Association shall provide the notices and mailing
requires by the Texas Occupations Code following the second cited violation,
and may cause such abandoned vehicle to be towed upon the happening of a
third violation within fifteen (15) days of the second cited violation.
